Last Tuesday, Strelia co-organised a webinar with the IBJ-IJE (Instituut voor bedrijfsjuristen - Institut des juristes d'entreprise) on proving damages in international disputes.
Joanna Kolber, Partner in our Dispute Resolution practice, had the opportunity to present "Proof of damages in international disputes – attorney’s perspectives to optimise your company’s chances for success."
Her presentation covered key legal and practical challenges related to proving damages in cross-border and domestic disputes.
She discussed:
- The importance of structuring damage claims beyond a simple “self-evident” approach, addressing key principles such as methods for calculating damage claims, foreseeability and mitigation.
- The challenges businesses face when substantiating damages, including complex internal reporting systems, financial damages, and external market factors.
- Effective strategies to overcome evidentiary hurdles, from contractual clauses on burden of proof and liquidated damages to best practices in evidence gathering and internal documentation.
